Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of Gym Daddy (the “Service”). By creating an account, booking a demo that leads to an account, or using the Service, you agree to these Terms. If you are using the Service on behalf of a gym or business, you represent that you are authorised to bind that organisation.

2. The service

Gym Daddy is a multi-tenant, cloud-based platform for managing gym members, payments, renewals, reporting and biometric attendance and access control. Features available to you depend on your subscription tier. We may add, change or remove features over time to improve the Service.

3. Accounts and security

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information and keep it up to date.
• You are responsible for the conduct of staff you grant access to, and for assigning appropriate roles and permissions.
• Notify us promptly of any unauthorised use of your account.

4. Subscriptions and billing

• Paid plans are billed in advance on a recurring basis (monthly or yearly) according to the plan you select. The Basic plan may be offered free for a limited promotional period.
• Fees are stated in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise; GST is applied as required.
• Plan limits (such as member, staff and branch counts) are enforced according to your tier. Exceeding limits may require an upgrade.
• Cancellation and refunds are governed by our Cancellation Policy and Refund Policy.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law, including data-protection and consumer laws.
• Upload data you do not have the right to use, or collect biometric or personal data without the necessary consent from your members.
• Attempt to gain unauthorised access to the Service, other tenants’ data, or our infrastructure.
• Interfere with, disrupt, or reverse-engineer the Service, or resell it without authorisation.

6. Your data and content

You retain all rights to the data you and your members enter into the Service. You grant us a limited licence to host and process that data solely to provide the Service. You are the controller of your members’ personal data and are responsible for having a lawful basis to collect and process it. Our handling of data is described in our Privacy Policy.

7. Third-party hardware and services

The Service integrates with third-party biometric devices (such as ZKTeco-class fingerprint readers) and payment and messaging providers. We are not responsible for the performance, availability or policies of third-party hardware or services, though we work to support widely used devices and providers.

8. Disclaimers

The Service is provided “as is” and “as available”. While we strive for high availability and accuracy, we do not warrant that the Service will be uninterrupted, error-free, or that it will meet every requirement. You are responsible for maintaining your own records as appropriate for your business.

9. Limitation of liability

To the maximum extent permitted by law, Gym Daddy will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data. Our total liability for any claim relating to the Service will not exceed the fees you paid to us in the twelve months preceding the claim.

10. Termination

You may stop using the Service and cancel at any time as described in our Cancellation Policy. We may suspend or terminate access if you breach these Terms, fail to pay fees, or use the Service in a way that risks harm to others or to the platform. Upon termination you may export your data during the applicable grace period.

11. Governing law

These Terms are governed by the laws of India, and the courts of India will have exclusive jurisdiction over any disputes, without regard to conflict-of-laws principles.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date and, where appropriate, by notice within the application. Continued use of the Service after changes take effect constitutes acceptance.
